Terms of service

These terms apply to your use of this website and to every promotion booked through it. By using the site or making a booking, you agree to them. If you don't agree, please don't use the site.

1. About us

This website is operated by Mitsuha Gaming (the "Creator"), a content creator based in India. Paresh Kotharkar receives payments and manages bookings, as manager, on behalf of Mitsuha Gaming. You can reach us at mitsuislive1905@gmail.com.

2. Who can book

Bookings are for businesses only. You must be at least 18 and authorised to bind the business you book for. We accept bookings made with a company email address, website and LinkedIn page, and may decline any booking at our discretion, for example if it fails our checks or doesn't suit our audience.

3. The Brand Promotion Agreement

Every booking is governed by the Brand Promotion Agreement you accept electronically on the booking page, under section 10A of the Information Technology Act, 2000. It sets out the deliverables, fees, payment schedule, creative control, content ownership and other terms of your promotion. If anything in these terms conflicts with your signed Agreement, the Agreement prevails.

4. Prices and payment

  • Prices are shown in Indian Rupees (INR). GST and other taxes apply as per Indian law.
  • Payments are made only through Razorpay and are received by Paresh Kotharkar, as manager, on behalf of Mitsuha Gaming. Never pay by any other method, even if asked.
  • Bookings of ₹5,000 or more are paid 50% upfront and 50% after the unlisted preview (or before going live, for promotions without a preview). Bookings under ₹5,000 are paid in full upfront.
  • Work starts only after Razorpay confirms the upfront payment, and nothing goes live until the full fee has been paid.
  • Late payments carry interest and recovery costs as set out in the Agreement.

5. No refunds

All payments are final. No refunds are given once a promotion is booked, except if the Creator fails to deliver for reasons within the Creator's control. See our Refund policy for the full details.

6. Media kit information

Channel statistics on this site come from YouTube and are refreshed regularly, but they may be delayed or temporarily unavailable. They describe past performance and are not a promise of future views, engagement, clicks, sales or any other result.

7. Your content and claims

You are responsible for the products, services, servers, claims and materials you ask us to promote, and for making sure they are lawful, accurate and yours to use. Every promotion is disclosed as paid, in line with the ASCI Guidelines for Influencer Advertising in Digital Media and the Consumer Protection Act, 2019. We may refuse or remove any promotion that breaks platform rules or the law, or that could harm our audience.

8. Intellectual property

The Creator owns this website's content, branding and all videos, streams and posts the Creator produces, including sponsored ones. You may link to and embed published content, but you may not download, re-upload, edit or use it in paid advertising without separate written permission.

9. Acceptable use

Don't misuse the site: no false bookings, impersonation, attempts to access the admin area or other people's data, scraping, malware, or anything that disrupts the site or breaks the law.

10. Third-party services

The site links to YouTube, Instagram, Discord, Razorpay and other services. They have their own terms and privacy policies, and we aren't responsible for their content or availability.

11. Limitation of liability

The site is provided "as is". To the extent permitted by law, our total liability to you for any claim relating to the site or a booking is limited to the fees we have actually received from you for that booking, and we aren't liable for indirect or consequential loss, or loss of profit, revenue, business or goodwill.

12. Governing law and disputes

These terms are governed by the laws of India.

If a dispute arises, we will first try to settle it through good-faith discussion for 15 days after one party notifies the other in writing. If it isn't settled, it will be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by mutual agreement (or, failing agreement, in accordance with that Act). The seat and venue of arbitration is Chandigarh, India, and the proceedings will be in English.

Subject to this, the courts at Chandigarh have exclusive jurisdiction, including for interim relief.

13. Changes and contact

We may update these terms from time to time; the date at the top shows when they last changed. Changes don't affect an Agreement you have already accepted. Questions or complaints can be sent to mitsuislive1905@gmail.com. Our Privacy policy explains how we handle your data.
